Event Summary

This conference focuses on a highly topical and sensitive area of immigration law. It deals with such issues as the new offences of illegal working and employing an illegal worker; sponsor duties under the latest Home Office Guidance and the Judicial Review procedure for challenging licence revocations in sponsor cases.

Two of BWB's industry leading Immigration team will be hosting sessions at the event. 

Chetal Patel, senior associate, will be looking at the 'hostile environment' and the effect on business immigration clients.  

This session will cover:

  • Illegal working: new offences of illegal working and employing an illegal worker
  • Right to Rent scheme: tenants who are in the UK unlawfully may face eviction
  • Driving: offence of driving when unlawfully in the UK and search powers
  • Bank accounts: mandatory checks on customer's immigration status and the power to close accounts

Tim Barnden, senior associate, will be presenting on Leave Under Section 3C, Curtailments, Appeals and Reviews. 

This session will cover: 

  • An over view of Section 3(C) Immigration Act 1971 as amended
  • The power to curtail, options to extend or vary leave
  • Remedies compared: admin review, appeals and judicial reviews
  • Is there such a thing as a viable 'human rights' appeal for the business immigration client?
  • Resisting 'certification'
  • Tactical and practical considerations to manage risks moving forward with an application
