The Charity Commission issued new guidance on 7 March on charitable engagement with the EU referendum campaign. Following concern expressed in the sector about the tone and content of the guidance, the Commission invited any views on areas in which the guidance does not reflect the underlying law. BWB has prepared this briefing setting out our view on areas in which it is misleading in law and how we will seek to interpret the guidance for consistency with underlying law and other relevant Charity Commission guidance. Our views have been provided to the Charity Commission and we are currently awaiting their substantive response.
