BWB's Melanie Carter and Claire Whittle have written an article for the Law Society Gazette on recent judgements which have offered insight into the rules of professional privilege.

In the article, Melanie and Claire discuss the court's consideration of two main points. Firstly, whether expressly limiting a waiver of privilege could be be used to prevent use of the information by the other side. Secondly, whether the doctrine of 'cherry picking' applies to the inadvertent disclosure of privileged documents.
